Shelter Me Video Contest Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. THE FOLLOWING CONTEST IS VALID IN THE UNITED STATES AND DISTRICT OF COLUMBIA (D.C.) ONLY, AND IS OPEN ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE OFFICIAL RULES (“OFFICIAL RULES”) BELOW). VOID ELSEWHERE AND WHERE PROHIBITED. DO NOT PARTICIPATE IN THE CONTEST IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.

CONTEST NAME: Shelter Me Video Contest (the “Contest”)

CONTEST DATES: Contest Registration and Video Submission Period is scheduled to begin at 12:00:00 pm Eastern Time (ET) on August 5, 2013 and ends at 11:59:59 pm (ET) on November 1, 2013 (the “Registration & Video Submission Period”).

Public Voting Period is scheduled to begin at 12:00:00 am Eastern Time (ET) on November 4, 2013 and ends at 11:59:59 pm (ET) on December 20, 2013 (the “Voting Period”).

Contest Judging Period is scheduled to begin at 12:00:00 am Eastern Time (ET) on January 6, 2014 and ends at 11:59:59 pm (ET) on January 10, 2014 (the “Judging Period”). Contest is subject to all applicable federal, state and local laws and regulations. Void outside the 50 United States and D.C. and where prohibited or restricted by law.

ELIGIBILITY – WHO MAY ENTER: Contest is open only to legal residents of the United States and the District of Columbia, who are age 13 or older as of date of entry, and have a valid U.S. driver’s license or government issued identification, except the following persons who are not eligible to enter or win:

  1. Employees of Radio Systems Corporation (“Sponsor”); Shelter Me (“Contest Administrator”); each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this Contest (collectively, “Released Parties”), and the members of the immediate families or households, whether or not related, of any of the above. “Immediate family members” includes, for purposes of this promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children (including step grand children) and each of their respective spouses, regardless of where they reside;
  2. Individuals who do not have access to the internet as of 11/01/2013 in order to visit Contest.ShelterMe.com to register and upload a video submission for the Contest;

How to Enter – Online Registration and Video Submission: To enter and upload your video submission, visit http://Contest.ShelterMe.com during the Registration & Submission Period. Each entrant must fully complete the online registration form with all required information, including his/her full name, complete address (including city, state and zip), valid email address, date of birth and phone number (including area code). All entries and video submissions in the Contest become the sole property of Sponsor and Contest Administrator.

After completing the online registration, each contestant will be required to upload and submit at least one (1) video, that is a maximum of 60 seconds and a minimum of 15 seconds in length, as part of his/her online registration and entry. Follow the online instructions to upload and submit your entry and video into the Contest (see video submission requirements below). The video submission for a completed entry should include:

  • A video no longer than 60 seconds and no shorter than 15 seconds that includes the required 5 second PetSafe® Brand video tag in at least one category: Adopt, Foster, Volunteer, Spay/Neuter or Wild Card (any issue that advocates for shelter animals).

After having read and agreed to these Official Rules, submit your entry and video submission to enter the Contest.

All entries must include all required information, and each video submission must conform to the video submission requirements as outlined above and below, or it shall be disqualified and not considered for the contest. Any entry or video submitted with incomplete information, an invalid email address or other inaccurate or incorrect information will be disqualified. All registration and video submissions must be received by 11:59:59pm ET on 11/01/2013 to be eligible.

Released Parties are not responsible for lost, late, misdirected, incorrect, illegible, incomplete, invalid, unintelligible, or damaged entries, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received due to any technical error or failure, human error, unauthorized human intervention, inaccurate capture or mis-entry of any required information, failures, omissions, interruptions, deletions, or defects of any phone or cellular phone provider, network computer online systems, computer equipment, servers, or software, including any injury or damage to contestant’s or any other person’s computer relating to or resulting from participation in this Contest; or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer, phone line or cellular transmissions and/or network connections; all of which will be disqualified.

Each contestant must submit an entry on his/her own behalf, using video submission of him/herself. Any other individuals included in the video, must provide entrant with express consent and permission for their images to be included and submitted in the contest, and such entrant is solely responsible for obtaining all authorizations or approvals. The individual who completed the online entry and submitted the video shall be designated as the official contestant competing in the Contest and shall be the only individual eligible for any resulting prize award (see below). Any entry completed and submitted on behalf of another individual or using another person’s name or email address, or use of any unauthorized video submissions will be disqualified. No mechanically produced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. False and/or deceptive entries or acts, including misrepresentation of age, shall render such entries ineligible.

In the event of a dispute as to any entry, registration or submission, the authorized account holder of the e-mail address used to register and associated with the entry will be deemed to be the registrant and s/he must be eligible according to these Official Rules. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Proof of being the authorized account holder may be required.

By registering and submitting an entry and video, you affirm that you have read and accepted these Official Rules. The laws of the United States apply to and govern this Contest and any claims must be raised and resolved in the United States. Any information collected by registering and entering the Contest shall be used only in a manner consistent with these Official Rules and with Sponsor’s Privacy Policy. All entries and video submissions received become the sole and exclusive property of the Contest Administrator. By entering the Contest, each contestant agrees that s/he may be contacted, recorded and/or broadcasted by the Contest Administrator, and that his/her video submission may be used, promoted, released, broadcasted or published by Contest Administrator and Sponsor in any manner related to the promotion or advertising of the Contest.

By participating and submitting an entry, contestant agrees that Contest Administrator and Sponsor and participating parties are authorized to contact contestant via email, mail, phone or any other form of media to make contestant aware of information pertinent to the Contest, and to distribute information regarding Sponsor’s featured products, offers, special events or promotional offers. Contestants may opt-out of any further email communication at any time, without affecting their entry, by simply replying REMOVE to any email message, or following the provided opt-out instructions. Collection and use of information collected in connection with the Contest will be in accordance with Contest Administrator’s Privacy Policy as posted on Contest.ShelterMe.com.

General Video Submission Requirements:

  • Each video must be submitted in a file format accepted by the Contest website;
  • The submitted video submission must not exceed 60 seconds duration in total length of the video, including the five second PetSafe® Brand video tag, and must comply with any file size limitations;
  • Each video submission entry should include:
    • Creative Concept in the categories: Adopt, Foster, Volunteer, Spay/Neuter, Wild Card (any issue that advocates for shelter pets).
    • Originality
  • Any video that is not properly submitted or received for any reason, including any technical difficulties, upload failures; failures to save or properly store the video; busy signals, or any lost or disconnected internet connections, will be disqualified.

Additional Video Submission Requirements: Contest Administrator reserves the right in its sole discretion, to disqualify any video submission for any reason that it considers to not be appropriate for the Contest. Restrictions include but are not limited to:

  • no nudity, sexually explicit or objectionable images;
  • no unauthorized videos or plagiarism of any kind;
  • no videos of any third party proprietary materials (including any third party trademarks), images or items;
  • no video that may be considered harmful to minors in any way;
  • no video that contains any political or politically themed or motivated comments, statements, or images;
  • no video that depicts or may be considered unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable in any manner as solely determined by Contest Administrator.

Representation and Release of Rights to Video Submissions: By submitting any video, each contestant represents that s/he has sole and exclusive ownership and proprietary rights of all video images submitted; has full permission of all parties within video to publish and release their images and actions shown within the video; and agrees that each video becomes the sole and exclusive property of Contest Administrator, and Contest Administrator and/or Sponsor may publish, display, promote, or utilize video in any manner of its choosing in relation to the promotion or advertising of the Contest. Entry into the Contest and upload of any video, constitutes permission for the Contest Administrator and/or Sponsor and its designees to use that contestant’s video, name, city and state of residence and/or likeness for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity without limitation or further compensation, notification or permission, unless prohibited by law.

Contest Administrator reserves the right, in its sole discretion, to disqualify any individual (and all of his or her entries) who tampers or attempts to tamper with or abuse the entry process or the Contest website in any way or who is otherwise in violation of these Official Rules, as determined by Contest Administrator or the Contest judges appointed by Contest Administrator in their sole discretion. Any questions regarding the number of entries submitted or the authorized account holder shall be determined by Contest Administrator in its sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY CONTEST WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Public Voting Period: In order to submit your vote(s) during the Contest, visit Contest.ShelterMe.com (“Contest Site”) between the “Public Voting Period” and follow the on-line instructions. Each entrant must fully complete the registration page with all required information. Maximum of one registration per valid email address during the Public Voting Period. After registering, each entrant will use their registered email address to log in to the Contest Site during the Public Voting Period to submit votes. After having read and agreed to these Official Rules, click the submit button to submit your registration. Any entry submitted with an invalid email address will be disqualified.

During the Public Voting Period, each entrant will be able to rate their favorite video, view the full video and share the video.

  • Limit: Registered entrants may submit up to one vote per day per video (see below).

Determination of Semi-Finalists: Following the close of the Registration & Submission Period, the Contest Administrator shall determine which (10) videos received the highest score during the Public Voting Period and designate them as the (10) ten semi-finalists. Scores will be calculated from the views, shares and votes a video receives.

The rating will be determined from the number of views, shares and votes a video receives as well as the average vote: each of the components can contribute at most 1 (one) point to the overall rating. The number of votes, shares or views is used to determine a score for the video relative to all other videos. Just because a video has several thousand more views, shares or votes than another video doesn't mean that it is weighted several thousand times more. Additionally, if a video has several thousand more views than shares or votes does not mean that the views will outweigh the shares and votes.

The average vote for a video is determined from weighted averages rather than a raw data average. We use several filters on the raw vote data to eliminate and reduce attempts to artificially inflate or deflate a video's average vote.

Ratings are normalized and can range from 1 to 4, with 4 being the maximum possible rating. The exact calculation used to determine ratings is secret, but the intent is to make sure all videos are considered fairly. The best videos as determined by the community will rise to the top.

In the event of a tie between two (2) or more videos, Contest Administrator shall conduct a random drawing to determine the ten (10) semi-finalists. Only the ten (10) selected semi finalist videos shall be eligible to participate in the Contest Judging Period. All other entries are disqualified, and ineligible to claim any prize.

Contest Judging Period: An independent panel of judges as solely determined and appointed by Contest Administrator shall review, select and designate the top three (3) videos from the Semi-Finalist videos. The video submissions shall be judged pursuant to the following general guidelines, requirements and criteria in the determination of the winning video submission. Each of the following categories shall represent how the semi-finalists and top 3 winners are determined:

  • 50% - Tie-in to theme: related to the shelter categories
  • 25% - Creative / original concept
  • 25% - Based on video ratings, views and shares

Based on these categories for the semi-finalists, the independent panel of judges will determine the top 3 winning videos. There are only 3 winning videos (1st, 2nd and 3rd place). All other entries are disqualified, and ineligible to claim any prize. Finalist selection is non-transferable.

In the event of a dispute as to any on-line registration, the authorized account holder of the e-mail address used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules. The “authorized email account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Proof of being the authorized account holder may be required.

Contest Administrator reserves the right, in their sole discretion, to disqualify any individual (and all of his or her entries) who tampers or attempts to tamper with the entry process or Contest website in any way or who is otherwise in violation of these Official Rules, as determined by Contest Administrator. Any questions regarding the number of entries submitted or the authorized account holder of an email address shall be determined by Contest Administrator in their sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY PROMOTION WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

The Released Parties are not responsible for lost, late, misdirected, illegible, incomplete, invalid, unintelligible, or damaged entries, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified.

The Released Parties are not responsible for any difficulty in viewing any videos, or delays in the posting of any videos during the Public Voting Period.

Each entrant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual or using another person’s email address or name will be disqualified and ineligible to claim any prize. No mechanically reproduced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void.

Winning Videos Notification: Each entrant who submitted a video that was designated as a winning video (i.e. 1st, 2nd or 3rd place) will be notified by phone at the number provided on their online registration form. Messages will not be left during the notification process. If after three attempts over a 72 hour period at the number listed on the registration form, Contest Administrator is unable to reach and speak directly with the potential finalist, then that finalist will be disqualified and is not eligible to participate in the contest or win any prize. Contest Administrator shall then determine which Semi-Finalist received the next highest vote total during the Public Voting Period and designate them as the selected grand prize finalist, and will notify the selected finalist per the procedures outlined above. This process will continue until the three winners are determined.

Contest Administrator reserves the right in its sole discretion to change the dates and times of the contest. Any changes will be posted on Contest.ShelterMe.com. Decisions of judges in the selection of finalist, and all matters related to this contest are final.

PRIZES:

First Place Prize: The semi-finalist who is designated as the first place prize winner will be awarded the first place prize. The first place prize is a $2,500.00 check made payable to the first place prize winner and a $2,500.00 check made payable to a public municipal shelter* of the first place prize winners choosing. If after a 90-day period a public municipal shelter has not been designated by the first place prize winner, Contest Administer reserves the right to designate a public municipal shelter on behalf of the first place prize winner. The first place prize winner’s video will be broadcast during a nationally televised program of Sponsor and Contest Administrator’s choosing.

Second Place Prize: The semi-finalist who is designated as the second place prize winner will be awarded the second place prize. The second place prize is a $1,500.00 check made payable to the second place prize winner and a $1,500.00 check made payable to a public municipal shelter* of the second place prize winners choosing. If after a 90-day period a public municipal shelter has not been designated by the second place prize winner, Contest Administer reserves the right to designate a public municipal shelter on behalf of the second place prize winner.

Third Place Prize: The semi-finalist who is designated as the third place prize winner will be awarded the third place prize. The third place prize is a $1,000.00 check made payable to the third place prize winner and a $1,000.00 check made payable to a public municipal shelter* of the third place prize winners choosing. If after a 90-day period a public municipal shelter has not been designated by the third place prize winner, Contest Administer reserves the right to designate a public municipal shelter on behalf of the third place prize winner.

* For the purposes of this Contest, Contest Administrator and Sponsor define animal shelters as municipal animal control agencies, run by city or county governments and private, non-profit agencies with a government contract to provide animal control services.

All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of Grand Prize winner, including but not limited to federal, state and local taxes. All grand prize awards are non-transferable and no cash redemption or prize substitution allowed, except at Administrator’s sole discretion or as provided herein. Administrator reserves the right to substitute a prize of comparable or greater value, at its sole discretion.

During prize winner notification, the selected potential prize winners must confirm their eligibility, and indicate their willingness to accept the prize. The potential prize winners will then receive official notification and prize delivery via email. Winner will be required to complete and return, within 5 days of date of receipt, an affidavit of eligibility, and liability/publicity release form (if winner is under 18 years of age at the time of award, this form must be countersigned by parent or legal guardian who is 18 or older).

Participation in Sweepstakes constitutes permission for the Sponsor, Contest Administrator and its designees to use entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law.

Winner(s) will be required to complete and return a W-9 form, affidavit of eligibility, and liability/publicity release, and present a copy of a valid driver’s license and social security card before prize will be awarded. Winners of prizes will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s). Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, contestant will not receive any other prize substitution or compensation. Total ARV of all prizes: $10,000.

Additional Rules & Restrictions: By participating in this Contest, contestants agree to abide by and be bound by the Official Rules and decisions of Sponsor and Contest Administrator, which shall be final in all matters relating to this Contest. In the event a contestant wins a prize, and is later found to be in violation of these Official Rules s/he will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Entry into Contest constitutes permission for the Contest Administrator and Sponsor and its designees to use contestants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render contestants ineligible for any prize.

By entering the Contest, contestants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to contestant’s participation in this Contest, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor.

In addition, by submitting any video, each contestant transfers any and all of his/her right, title and interest in and to such video, including but not limited to any and all copyrights, trademark rights, "moral rights" and any and all other proprietary rights that may exist, throughout the world, to Sponsor and expressly waives any rights s/he may have in such submission. Each contestant agrees Contest Administrator is the exclusive owner of all rights in and to such video submission, and will have the worldwide, perpetual right to copy, display, reproduce, exhibit, edit, modify, assign, license, register for copyright or trademark, distribute, sell or otherwise use and exploit the video submission and all elements and/or derivative works thereof, in whole or in part, alone or with other materials, in any media now known or hereafter created or devised, for any reason whatsoever.

Released Parties shall not be liable to any winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control.

Contest Administrator reserves the right to cancel, modify or terminate the Contest if fraud, misconduct or technical failures destroy or threaten the integrity of the Contest, in the opinion of the Sponsor or Contest Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest as determined by Sponsor or Contest Administrator, in its sole discretion. In the event of early termination of the Contest, Contest Administrator reserves the right to select Grand Prize Winner from among all eligible, non-suspect entries received as of the time/date of such termination. Contest Administrator reserves the right to add, delete, edit and / or change any of the downloadable assets.

IN CASE OF DISPUTES: By entering, each contestant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will contestant be entitled to received attorneys' fees or other legal costs; and (3) under no circumstances will contestant be permitted to obtain awards for, and contestant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestant and Contest Administrator in connection with this Contest, shall be governed by, and construed in accordance with the laws of the State of State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
